1. Introduction

  1. We are committed to safeguarding the privacy of our website visitors and our service users, that is why we disclose this privacy policy document (hereinafter: policy) for you. This policy aims to inform you about how we collect and process any information that we collect from you, or that you provide to us. It covers information that could identify you (“personal information”) and information that may not. In the context of the law and this notice, “process” means collect, store, transfer, use or otherwise act on information. It tells you about your privacy rights and how the law protects you. This policy applies where we are acting as a data controller with respect to the personal information of our website visitors and service users; in other words, where we determine the purposes and means of the processing of personal information.
  2. n this policy, “we”, “us” and “our” refer to Fox in a Box AB. For more information about us, see Section 18. Our policy is not just an exercise in complying with the law, but a continuation of our respect for you and your personal information.
  3. We undertake to preserve the confidentiality of all personal information you provide to us, and hope that you reciprocate.
  4. Our policy is intended to comply with the EU General Data Protection Regulation (GDPR) and Law 25 in Quebec.
  5. The law requires us to tell you about your rights and our obligations to you regarding the processing and control of your personal information.
  6. Except as set out below, we do not share, or sell, or disclose to any third party, any personal information collected through our website. 
  7. We use cookies on our website. Insofar as those cookies are not strictly necessary for the provision of our website and services, we will ask you to consent to our use of cookies when you first visit our website.

2. Data we process

  1. We may collect, use, store and transfer different kinds of personal data about you. We have collated these into groups as follows:
    • Your identity includes information such as first name, last name, title, date of birth, and other identifiers that you may have provided to us at some time.
      • When registering on our site, as appropriate, you may be asked to enter your
        • Full name
    • Your contact information includes information such as billing address, delivery address, email address, telephone numbers and any other information you have given to us for purposes of communication or meeting with you.

        • from and to in case of buying a voucher
      • We are sending emails and text messages for you regarding the game such as:
        • confirmation email
        • reminder email
        • “Thank you email” after the game with team photo.
        • SMS
        • newsletter
      • These emails and messages make easier the possible cancellation of the game for you by clicking on a link in the email/text message.
      • For automatic email sending we are using Mailgun, Buzzshot, Mailchimp, TripAdvisor or our own mailing system, provided by AWS. The privacy policies of these two providers you can find on the below links:
    • Technical data includes your internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.
    • Marketing data includes your preferences in receiving marketing from us; communication preferences; responses and actions in relation to your use of our services.
    • Camera pictures: In our rooms we are operating a surveillance camera system which is used to supervise the games and to watch for your safety. We are not recording or storing videos and we are not allowing any third parties to have recordings from our customers.
    • Pictures after the game: We’re taking group pictures of the players after the game and upload it to social media platform (such as Facebook) and/or send it over to you by email. If you don’t want your team picture to be uploaded to Facebook, please, inform the game master on site.
    • Game logs: We are collecting data about the games through a controller system which is connected to the Fox In A Box special proprietary systems in the rooms. We can track when you have started and finished the game, which doors have been opened, which game(s) have been solved, etc. We connect this database with our reservation system, so we now if there is a game in the room which doesn’t have a reservation. We use this game logs to supervise the number of the games and make statistics about them.
    • Social media: We may collect other data that you submit via our social media accounts as well as other means of communication. For example, we may collect personal data when you provide feedback or when you participate in interactive features such as surveys, contests, or promotions.
    • Newsletter: At any time, you can subscribe or unsubscribe from our newsletter.  Your email is collected for sending information using Buzzshot. While these third parties don’t have access to your data, it is nonetheless hosted on their platform.
    • We are storing the following data to perform our contractual relationship, fulfil your reservation and to prepare statistics and bookkeeping:
      • price of the game
      • number of the players 
      • number of guests
      • pay type (bank card, on the spot, etc.)
      • cancellation email
      • the time when the booking/reservation has been made.
    • We are not storing any kind of financial data on our system; we use payment service provider Moneris in this respect. Moneris privacy policy can be found here: https://www.moneris.com/en/legal/privacy-noticeSecurity of the information storing is the responsibility of the payment services providers who are controlled under PCI compliance standards.
    • Before you start any kind of game experience created by us, for marketing purposes and for proving that you have understood the rules and rights in connection with our services, we are asking you to sign a waiver on site. This waiver might contain questions in connection with your personal and non-personal information.
  2. We collect the above-mentioned personal information from you when you fill out the form or enter your personal data on our website or at our rooms to fulfill our contractual obligations with you and provide you the best gaming and costumer experience. We also have an own reservation system in which the above mentioned (personal) information might be stored so we can prepare for your reservation. This reservation system is secured and is not and will be not disclosed to any third party except for our Affiliates or where so instructed by a court of public authority under mandatory law.

3. Special personal information

  1. Sensitive personal information is data about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. It also includes information about criminal convictions and offences.
  2. We do not collect any special personal information about you.

4. If you do not provide personal information we need

  1. Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform that contract. In that case, we may have to stop providing a service to you. If so, we will notify you of this at the time.

5. The bases on which we process information about you

  1. The law requires us to determine under which of the below bases we process different categories of your personal information, and to notify you of the basis for each category.
  2. If a basis on which we process your personal information is no longer relevant, then we shall stop processing your personal information as soon as reasonably possible.
  3. If the basis changes and we are required by law to do so, we shall notify you of the change and of any new basis under which we have determined that we can continue to process your information.

6. Information we process because we have a contractual obligation with you

When you make a registration/reservation on our website for a game, buy a service from us, or otherwise agree to our terms and conditions, a contract is formed between you and us.

To carry out our obligations under that contract we must process the information you give us. Some of this information may be personal information.

We may use it particularly to:

  • verify your identity for security purposes.
  • sell products to you.
  • provide you with our services.
  • provide you with suggestions and advice on games, services and how to obtain the most from using our website.

We process this information on the basis there is a contract between us, or that you have requested we use the information before we enter a legal contract.

We shall continue to process this information until the contract between us ends or is terminated by either party under the terms of the contract.

7. Information we process with your consent

Through certain actions when otherwise there is no contractual relationship between us, such as when you browse our website or ask us to provide you more information about our business, including the games or our services, you provide your consent to us to process information that may be personal information.

Wherever reasonably possible, we aim to obtain your explicit consent to process this information, for example, by asking you to agree to our use of cookies on your first use of the website. You may withdraw your consent at any time by instructing us on the franchise@foxinabox.re. However, if you do so, you may not be able to use our website or our services further.

We may process information on the basis there is a legitimate interest, either by you or by us, of doing so.

Where we process your information on this basis, we do so having carefully considered:

  • whether the same objective could be achieved through other means
  • whether processing (or not processing) might cause you harm
  • whether you would expect us to process your data, and whether you would, in the round, consider it reasonable to do so

For example, we may process your data on this basis for the purposes of:

  • record-keeping for the proper and necessary administration of our organization
  • responding to unsolicited communication from you to which we believe you would expect a response
  • protecting and asserting the legal rights of any party including our affiliates
  • insuring against or obtaining professional advice that is required to manage organizational or business risk
  • protecting your interests where we believe we have a duty to do

9. Information we process because we have a legal obligation

Sometimes, we must process your personal information to comply with a statutory obligation.

For example, we may be required to give personal information to legal authorities if they so request or if they have the proper authorization such as a search warrant or court order. In this case we notify you – if it is allowed – about this personal information transfer.

2. Personal identifiers from your browsing activity

Requests by your web browser to our servers for web pages and other content on our website are recorded.

We record information such as your geographical location, your Internet service provider, and your IP address. We also record information about the software you are using to browse our website, such as the type of computer or device and the screen resolution.

We use this information in aggregate to assess the popularity of the webpages on our website and how we perform in providing content to you.

If combined with other information we know about you from previous visits, the data possibly could be used to identify you personally, even if you are not signed into our website.

3. Our use of re-marketing

Re-marketing involves placing a cookie on your computer when you browse our website to be able to serve to you an advert for our products or services when you visit some other website.

We may use a third party to provide us with re-marketing services from time to time. If so, then if you have consented to our use of cookies, you may see advertisements for our products and services on other websites.

Although we do not disclose your personal information to any third party (except affiliates and as set out in this notice), we sometimes receive data that is indirectly derived from your personal information from third parties whose services we use.

No such information should be personally identifiable to you.

We are transferring data to our contractual partners who provide technical support to maintain our worldwide booking system (Nitronwise Kft, Budapest, Hungary and Softtronic DOO, Senta, Serbia) which data transfer may include personal information. We and – to our knowledge – our abovementioned partners are each processing this data with the highest level of safety and fully compliant to GDPR.

  1. Data will be processed outside of Quebec

As Fox in a Box AB is a franchise operating worldwide, many services are not hosted nor processed entirely in Quebec.  Therefore, all personal data we collect in accordance with this Provacy Policy is processed outside of Quebec and outside of Canada, though in accordance with GDPR.

We use the following safeguards with respect to data transferred outside Quebec.

  • the processor is within the same corporate group as our business or organization and abides by the same binding corporate rules regarding data processing.
  • the data protection clauses in our contracts with data processors include transfer clauses written by or approved by a supervisory authority in the European Union and Law 25.

We do not sell, trade, or otherwise transfer to third parties your personal information unless we provide you with advance consent. This does not include information transfers to our Affiliates, website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe such release is required to comply with the law, enforce our site policies, or protect our rights, property, or safety. However, non-personal information may be provided to other parties for marketing, advertising, or other uses at any time.

For European citizen, you may do so in the EU member state of your habitual residence, your place of work or the place of the alleged infringement.

  1. If you are under 18, you may use our website and participate in our games only with consent from a parent or guardian.
  2. We collect data about all users of and visitors to these areas regardless of age, and we anticipate that some of those users and visitors will be children.
  3. Such child users and visitors will inevitably visit other parts of the site and will be subject to whatever on-site marketing they find, wherever they visit.

17. Encryption of data sent between us

  1. Fox in a Box protects information both online and offline. However, we do not collect any passwords, credit card or card numbers, the transmission of information is encrypted and protected using Secure Sockets Layer (SSL) to perform the best protection of the information.

  1. If you are not happy with our privacy policy or if you have any complaint, then you should tell us.
  2. If you are in any way dissatisfied about how we process your personal information, you have a right to lodge a complaint with the supervisory authority. We would, however, appreciate the opportunity to talk to you about your concern before you approach the supervisory authority.
